GENERAL TERMS AND CONDITIONS
1. scope of application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded (hereinafter referred to as "order") via the online shop of Vegan Tartar c/o Rossella Galatioto (hereinafter referred to as "Vegan Tartar").
Vegan Tartar reserves the right to change the GTC. The version of the GTC valid at the time of the order is decisive, which cannot be changed unilaterally for this order.
The offer is directed to natural customers with domicile or legal customers with domicile in Switzerland. Deliveries will only be made to addresses in Switzerland.
The offer is valid as long as it is visible in the online shop and/or as long as stocks last. Prices and product ranges are subject to change at any time. The images shown in the online shop as well as all information on the products are for illustration purposes only and are not binding.
Prices are quoted in Swiss francs, including value added tax (VAT). The price in the online shop at the time of the order is decisive.
The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalogue or a non-binding invitation to the customer to order the product in the online shop.
An order is considered an offer to Vegan Tartar to conclude a contract.
A minimum order value applies per order. The minimum order values communicated in the online shop and the delivery cost guidelines apply.
After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by Vegan Tartar.
Vegan Tartar is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of undeliverable products. Temporarily unavailable products cannot be reserved.
5. payment options
Payments must be made in Swiss francs.
Credit cards and debit cards are accepted as means of payment. The available means of payment are displayed in the online shop.
The amount will be debited immediately.
Purchase on account is not possible.
6 Conclusion of contract
A contract is only concluded when the order is processed in the Vegan Tartar logistics centre. As soon as the order has been prepared for dispatch, the customer will receive an order confirmation by e-mail.
The customer's delivery address must be in Switzerland.
No deliveries will be made on weekends and official national or cantonal holidays.
If the customer is not present at the time of delivery and has not given any special delivery instructions, the delivery man will leave a collection invitation in the letterbox. The clientele must then collect the delivery from the relevant post office.
Any order not collected within the specified time limits will not be held or refunded. The customer is solely responsible for orders collected late and any rights to claim for defects are excluded.
Customers are requested to confirm their collection additionally by their signature. Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the collection process or the collection slip is expressly excluded.
The customer assumes responsibility for the delivered products, even if they were not received directly by him/her.
8. delivery costs
The delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping basket and on the invoice.
Vegan Tartar can provide warranty either by partial or complete replacement with an equivalent product.
The buyer bears the costs for returns. Returns must be arranged in advance with Vegan Tartar (firstname.lastname@example.org).
11. notice of defects
If products are delivered with obvious damage to the packaging or the contents, the customer must immediately complain to the delivery messenger and refuse acceptance, without prejudice to his rights in respect of defects. The customer is obliged to obtain a damage confirmation report from the delivery carrier. All transport damages must also be reported to Vegan Tartar immediately.
Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt. For any defects or deviations from the order, the customer service of Vegan Tartar must be notified by e-mail email@example.com on the day of delivery. Vegan Tartar reserves the right to request proof of the defect.
12. transfer of risk
The risk is transferred to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of our own, the risk shall pass to the buyer upon notification of readiness for shipment. If Vegan Tartar has agreed to bear the transport costs in an individual case, this shall not affect the transfer of risk.
13 Limitation of Liability
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, except in cases of wilful misconduct or gross negligence. No liability is accepted for consequential damage arising from the use of the products.
14 Applicable court and place of jurisdiction
Grenchen shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
